The New San Siro Stadium (Milan, Italy) project can continue moving forward: The Lombardy Regional Administrative Court (TAR) has rejected the five appeals filed against the sale of the current San Siro Stadium and its land to the Serie A teams Inter Milan and AC Milan.
Administrative Appeals
‘gazzeta.it’ stated that the above brings to an end the administrative appeals, some of which began as early as 2022, which were consolidated into a single hearing held on June 23rd. Specifically, four appeals were declared inadmissible for procedural reasons while one was dismissed on the merits.
The Inter Milan is an Italian professional football club based in Milan, Lombardy (Italy). Inter is the only team to have an unbroken presence in the top division of Italian football, Serie A, since its debut in 1909, having never been relegated to Serie B. The San Siro Stadium serves as their home pitch.
The AC Milan or simply Milan is an Italian professional football club based in Milan, Lombardy (Italy). Founded in 1899, the club competes in Serie A, the top tier of Italian football. The San Siro Stadium serves as their residence.
The Stadio Giuseppe Meazza, commonly known as the San Siro Stadium, is a football stadium in the San Siro district of Milan, Italy. The venue has a seating capacity of 75,817 thus making it the largest stadium in Italy and one of the largest stadiums in Europe. It serves as the home venue of the top-flight clubs – the AC Milan and the Inter Milan.
The new San Siro project is a joint development by the AC Milan and the Inter Milan to build a modern 71,500-seat stadium adjacent to the historic San Siro (Giuseppe Meazza) Stadium in Milan, Italy.
The Lombardy Regional Administrative Court (TAR) is the first-instance administrative court for the Lombardy Region of Italy, based primarily in Milan.
Declared Admissible
‘gazzeta.it’ further stated that two appeals in 2022 – the oldest appeal, from 2022, was filed by a group of citizens and individuals opposed to the transformation of the San Siro Stadium. Over the years, however, the appellants changed several times and the legal case progressed through several stages. The Lombardy Regional Administrative Court (TAR) found that the conditions were not met to reach a decision on the objections and, therefore, declared the appeal inadmissible. The same result was found for the other major appeal from 2022. This case, too, challenged various aspects of the San Siro Stadium project, from the administrative procedure to the transformation of the area. The TAR, however, stopped short of examining the merits: Over the years, the parties involved had changed, and the objections had been filed at different times and against different actions. This appeal was, therefore, also declared inadmissible.
Third Case
The third case concerns a much more recent phase, that of the initiation of the procedure that led to the sale of the area. The 2025 appeal challenged some of the documents based on which the City of Milan had begun the process of selling the San Siro Stadium to Inter Milan and AC Milan. According to the judges, however, the appeal only targeted part of a broader process thus leaving out the other documents that constituted previous or subsequent steps: Hence, its inadmissibility.
Fourth Case
The fourth case – The same thing happened with the subsequent appeal, the one that most directly concerned the final phase of the sale. The appellants challenged the possibility of selling the entire San Siro complex through the procedure used by the Municipality and questioned various aspects of the transaction, from the price to the terms of the sale. The appeal was declared inadmissible because, according to the judges, it had only challenged one part of the procedure without also calling into question the previous documents on which that step depended.
Fifth Appeal
The only appeal on the merits – Then there is the fifth appeal, the only one in which the Regional Administrative Court (TAR) truly examined the merits. It was filed by the City Councilor Enrico Fedrighini of the mixed group challenging the approach taken by the Milan City Council to approve the sale of the San Siro Stadium. Fedrighini primarily challenged the way the committees and amendments had been handled during the resolution process. According to the Councilor, certain rules had not been respected, which would have limited his powers. On this point, the Regional Administrative Court (TAR) instead examined the objections and dismissed them. The judges reconstructed the committee meetings noting that the proposal had been discussed on multiple occasions and that Fedrighini himself had participated in the proceedings. Therefore, no concrete limitation of his functions had been demonstrated. The Regional Administrative Court also ruled against the Councilor regarding the modifications to the amendments: The contested sub-amendment had not entirely canceled the previous amendment and the lapse of incompatible proposals was provided for by the City Council rules.
The Consequences
Now, the Inter Milan and AC Milan, as well as the City of Milan, can celebrate. The clubs are preparing to present the final design for the new stadium and complete all the necessary formalities to allow construction to begin. The first step will be the presentation of the new rendering, expected between the end of October and the beginning of November. The project will then move on to the various evaluation phases planned by the city and the Region. The goal remains to complete the process by summer 2027 and begin construction in the second half of the year once the football season has concluded. From then on, the real race against time will begin: The New San Siro must be ready by 2031 to allow Milan to host the 2032 European Championships.
The 2032 Union of European Football Associations (UEFA) European Football Championship, commonly referred to as UEFA EURO 2032 or simply EURO 2032, will be the 19th UEFA European Championship, the quadrennial international football championship organized by UEFA for the senior Men’s national teams of its Member associations. Italy and Türkiye will host the tournament which is expected to take place between June and July 2032.
