The Massachusetts Supreme Judicial Court has ruled that the city of Boston can continue building the White Stadium in Franklin Park in Boston, Massachusetts (US) handing the Mayor of Boston Michelle Wu a big victory on a high-stakes project that’s been a priority for her administration. The venue will serve as the abode of the National Women’s Soccer League (NWSL) team Boston Legacy FC and is scheduled for a summer 2027 opening.
Community Use
Wu said in February that the community will use it “90-plus percent of the time”.
The stadium will be open to the public from 6 am to 9 pm every day of the week except for days with team events, the professional soccer games and the school activities.
Landmark Investment
Enthused Mayor Wu, “We are thrilled [with] the court’s decision – clear, unanimous – decisively ruling that this landmark investment in our future can move forward without further delay.”
She said she gets weekly updates on construction which has been going smoothly with a planned summer 2027 opening.
Wu said the community feedback and the legal challenge pushed the city to get the best result – “We are better for that.”
Change in Use
‘wbur’ stated that the case centers on a lawsuit from the Emerald Necklace Conservancy and the Franklin Park Defenders who said the rebuild violates the State laws that cover the use of the public park land. They said the project – a public-private partnership (PPP) that splits the $325 million cost between the city and the professional women’s soccer team – the Boston Legacy FC – illegally privatizes the public parkland and would require an act of the Legislature for a change in use.
The White Stadium, formally the George R. White Memorial Stadium, is a 10,519-seat stadium in Boston, Massachusetts (US) that was constructed between 1947 and 1949 for the use of the Boston Public Schools athletics. It is located in Franklin Park. The stadium is planned to be renovated into an 11,000-seat soccer venue for the NWSL team Boston Legacy FC.
The Boston Legacy FC is an American professional soccer team based in the Greater Boston area (US) that competes in the National Women’s Soccer League (NWSL), the highest level of the United States soccer league system.
The 64,628-seat Gillette Stadium is a multipurpose stadium located in Foxborough, Massachusetts, United States. It serves as the home venue of the Boston Legacy FC.
The Emerald Necklace Conservancy is a private, nonprofit group founded in Boston in 1997. It works to protect, maintain and restore Boston’s famous 1,100-acre Emerald Necklace park system.
The Franklin Park Defenders is a coalition of the Boston residents, the local organizations and the Emerald Necklace Conservancy. They have been formed to oppose the commercialization and partial privatization of the White Stadium inside Boston’s historic Franklin Park.
Double Delight
‘wbur’ further stated that the court gave the city two big wins, first ruling that the plaintiffs had no standing to challenge the project over the alleged violations of the terms of the public charitable trust that technically owns the White Stadium. They also concluded that even though the land the stadium was later built on was taken by the eminent domain to be used as a public park in 1883, the stadium parcel had since been “dedicated to another use”. Two pieces of legislation from 1947 and 1950 effectively “made it a school department facility to be maintained by the school committee”.
Conservation Areas
The plaintiffs chiefly relied on an argument that the land was protected by a State law from 1972 that limits how the conservation areas can be converted to other uses. They insisted that a private company couldn’t make money off the public parkland or limit the public’s access. But the High Court ruled that the land wasn’t subject to the law’s provisions.
‘Generational Project’
Mayor Wu praised the court’s decision calling the stadium rebuild a “generational project” that will deliver a “state-of-the-art facility” to the student-athletes and the wider community.
Fully Public Project
The Emerald Necklace Conservancy President Karen Mauney-Brodek said in a statement that the group was disappointed by the ruling – “We do not think the current proposal is the right one for the park or the communities that surround it.”
She reiterated a call for a smaller, less expensive and fully public project.
When completed the 10,000-seat stadium will serve as the new home for the Boston Legacy FC and as a hub for the Boston Public Schools athletics.
The Supreme Judicial Court decision affirmed a Suffolk Superior Court judge’s ruling that sided with the city in 2024. The plaintiffs then appealed the ruling to the Supreme Judicial Court leading to the above decision. They’ve criticized the city for continuing to build while litigation is pending.
‘Tremendous Victory’
The Boston Legacy FC, which is paying $190 million for its portion of the rebuild, described the ruling as a “tremendous victory”.
‘World-class Facility’
Averred Jennifer Epstein, Controlling Owner, Boston Legacy FC, “The Court’s decision clears the way for completing the White Stadium renovation and delivering a world-class facility that will serve our community for generations and sets a national standard for the youth athletics and professional women’s soccer.”
‘Not Right Plan’
Jamaica Plain (neighborhood in Boston) resident Renée Stacey Welch, a plaintiff who opposed the stadium project, said that while the lawsuit was not successful in the courts it drew attention to an issue the residents had been highlighting for years – “We’re united around our vision of a truly public White Stadium, not a giveaway to the private investors. And we continue to believe that building a private professional soccer stadium and entertainment complex for a group of wealthy investors is not the right plan for Franklin Park, for the communities that surround it, or for Boston’s kids.”
Lease Agreement
The city and the Boston Public Schools will maintain ownership of the stadium under a 10-year lease agreement with the Boston Legacy. The soccer team plans to use the stadium for up to 20 games and 20 practices a year. The rest of the year the facility is meant to be used by the Boston Public Schools athletics and for the community events though the high school football games will not be allowed at the stadium during the soccer season.
Mounting Criticism
Mayor Wu has personally championed the project for years defending the plan as a once-in-a generation opportunity – despite mounting criticism over the cost, the transit, the parking, and the risk of potential gentrification in the surrounding neighborhood. It became a key point of division between her and the 2025 Mayoral challenger Josh Kraft.
Financial Protection
If the court ruled against the city Wu had said it would have been protected financially.
She said in February, “In the off chance that this case doesn’t go how every other decision has gone at the lower court level – strongly in favor of the city the lease documents protect the city.”
