Hertha BSC bans commercially produced-monetized stadium vlogs

Hertha BSC bans commercial stadium vlogs

Attending a German football club Hertha BSC (Germany) match should be, above all, a shared football experience. The fans should be able to experience the games, the atmosphere and the support for the team without the stadium events being filmed by the cameras for commercial content productions.

Stadium Vlogs

‘HerthaBSC’ stated that to facilitate the above the Hertha BSC will be handling the stadium vlogs (a creator documents their live experience attending a sports match, concert, or large event inside a stadium) more consistently in the future. Specifically prohibited are the commercially produced and monetized vlogs that use professional camera and production equipment and are subsequently used commercially via the video platforms or the social networks. Private photo and video recordings for personal use will, of course, remain permitted.

Joint Decision

The above decision was made jointly by the management, the executive board, the communications and media department, and the event and matchday management. The security personnel deployed on matchday have been informed accordingly.

The Hertha BSC is a German professional football club based in Berlin (Germany). The Hertha BSC plays in the 2. Bundesliga, the second tier of German football, following relegation from the Bundesliga in 2022-2023.

The 74,475-seat Olympiastadion, also known in English as the Berlin Olympic Stadium or simply the Olympic Stadium, is a sports stadium at Olympiapark Berlin in Berlin, Germany. It serves as the residence of the Hertha BSC.

Stadium Regulations

‘HerthaBSC’ further stated that this is based on the applicable ticket and the stadium regulations as well as the existing media and exploitation rights. For the Bundesliga (the highest level of the German football league system) and the 2. Bundesliga matches the Bundesliga Group’s guidelines for the individual use and exploitation of the media marketing rights also apply. As a club, the Hertha BSC is itself subject to these guidelines when producing and publishing its own matchday content. Therefore, the independent commercial exploitation of the matchday and the stadium content by the third parties is not permitted without the club’s explicit consent.

Frankfurt (Germany)-based the Bundesliga Group is a league and a wholly-owned subsidiary of the Bundesliga e.V. (an association of the 36 German professional football clubs [or their companies] that partake in the Bundesliga and the 2. Bundesliga). The Bundesliga Group is responsible for the entire operating business of the Bundesliga and the 2. Bundesliga leagues.

Relevant Regulations

The relevant regulations already exist. The Hertha BSC has, in the past, sometimes been less consistent in enforcing them. This will change in the future. The club will exercise its right to control access to its property and implement the existing regulations accordingly.

Recordings Prohibited

The visitors who wish to enter the Olympiastadion with clearly identifiable professional production equipment for creating the commercial stadium vlogs should, therefore, expect that such recordings will be prohibited and that such equipment will not be permitted for use in the stadium.

Private Snapshots

The private snapshots remain explicitly unaffected: Anyone using their smartphone to capture a special moment in the stadium, take a photo, or share brief personal impressions with others is not affected by this regulation. The crucial point is the distinction between the private fan content and the commercial content production.

Shared Stadium Experience

The Hertha BSC has asked all the stadium visitors to be understanding and to contribute to ensuring that the Olympiastadion remains a place of football, emotions and a shared stadium experience.
